These terms and conditions apply to the use of this website (Ten Feet High) and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this website.
Acceptance of your Order
The display of any item on our website is not an offer to sell and TEN FEET HIGH shall be under no obligation to supply the products ordered through this website. If you place an order, this will be your offer to purchase the items from us. We will acknowledge your order by email as soon as possible but will be under no obligation to supply the products ordered unless we have the products in stock and they are available at the prices specified.
Unless you cancel your order in accordance with our Cancellation policy below, acceptance of your order and completion of the contract between you and TEN FEET HIGH will be perfected when we dispatch the goods to you.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn. In the event of a product being out of stock, we will inform you.
Furthermore we may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the website whether or not that merchandise has been sold or refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
Payment
All of our items are priced in UK pounds sterling and include any VAT payable, but exclude delivery charges (all UK delivery charges are added before your final chance to accept the transaction please phone 01142 511717 for a quote for Shipment outside the UK). The total cost of your order will be the price of the products plus delivery.
Payment will be debited and cleared from your account upon receipt of your order. The credit/debit card that is being used must be yours. All credit/debit card holders are subject to validation checks and authorization by the card issuer.
If the issuer of your payment card refuses to authorize payment, we will not be liable for any delay or non-delivery of your order. We also reserve the right to cancel your order. We may request that shipping be to the credit card billing address only.
By submitting an order to us through our website you represent and warrant that the payment details provided on your order are valid and correct and that when your order is accepted and processed by us, payment will be made in full.
We accept payment by most major credit and debit cards. Payment is deducted when we process and despatch your order. All items remain the property of TEN FEET HIGH until payment is received and cleared in full.
We take all reasonable care to make our Site as secure as we can make it. Delivery
Delivery within the UK is usually via www.parcelforce.com. Delivery times and prices will be quoted at the time of purchase.
Most orders will be dispatched within 3 working days subject to credit clearance, address verification and availability of items. We will contact you if there is a delay or items are out of stock. Please also note that any duty and taxes incurred in the country of destination are the responsibility of the customer.
Limitation of Liability
We make no warranty that the website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or is compatible with any other software or material. Accessing the website is entirely at your own risk. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control. Our Rights
We reserve the right to modify or withdraw, temporarily or permanently this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website. We may change or modify these terms and conditions at any time, and your continued use of this site following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the conditions have been changed. If you do not agree to any change to the terms and conditions, then you must immediately stop using the website.
Return/Cancellation policy
To cancel and order we need to be notified within 7 days of delivery. You are covered by the Distance selling regulation.
Under the Distance Selling Regulations, buyers have a period of 7 working days after the date of delivery within which they can cancel the contract (often referred to as the "cooling off" period) and get their money back, including the original postage and packing charges as long as the item is returned unused and in the same condition, and in the original packaging it left us.
Before you return something you must notify us within 48 hours of receiving an item and obtain a Return Authorization number by emailing us via our contact form. Please include your original receipt in the returned parcel. You must write your Return Authorization number on the receipt. Any returned items that are not accompanied by an official reference number will not be accepted.
We will not accept returns for any non-faulty items that have been worn or used and tags removed. We strongly advise all customers to check items thoroughly upon delivery before removing any tags and before disposing of the original packaging. Please be aware that all item(s) must be returned with its original packaging.
Please send all returns to TEN FEET HIGH, c/o Sheffield Cable Waterski, Rother Valley Country Park, Mansfield Road, Wales Bar, Sheffield, S26 5PQ. The product you return must be in new, unworn/unused condition with all the original packaging and all tags still attached. We do not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser.
If you wish to receive a refund we will re-credit the original purchaser's credit card for the sum paid less any taxes and duties. International customs duties and sales tax are NOT refunded for shipments outside the European Community.
It is advisable to send returned items by registered post and keep your proof of postage certificate, as we cannot be responsible for goods lost or damaged in transit. Please note that postal costs for returned goods are the customer’s responsibility. Reimbursed of post by us will only be given the case of damaged, faulty or incorrectly supplied goods. Customers' statutory rights are unaffected.
Pre-orders
We sometimes will offer the possibility to pre-order an item before it is available in the country. In this case when you place your order we will take payment in full for the item and keep a record of you having ordered it. When we receive shipment of the product from our supplier we will then ship your item to you. We are unable to guarantee delivery dates for pre-ordered items, only offer an estimate of when they will arrive with us as we are subject to delays resulting from international shipping over which we have limited control. In the unlikely event that we cannot fulfil these orders we will of course offer a full refund.
Gift Vouchers/Cards
Redemption
Gift Cards must be redeemed toward the purchase of eligible products on www.tenfeethigh.com.
Limitations.Gift Cards cannot be reloaded, resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law.
Risk of Loss
The risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission to the purchaser, recipient or delivery to the carrier, whichever is applicable. We are not responsible if a Gift Card is lost, stolen, destroyed or used without your permission.
Fraud
Tenfeethigh.com will have the right to close customer accounts and bill alternative forms of payment if a fraudulently obtained Gift Card is redeemed and/or used to make purchases on tenfeethigh.com.
Limitation of Liability
TEN FEET HIGH MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD CODE.
